At LuluHives, our mission is to eradicate housing precariousness and the “double rent” trap for students. But to do that legally and safely in France, transparency is key. You can’t just hand over your keys to a fellow student, you need explicit permission from your landlord and clear boundaries for your guest.

That is why we mandate the Residential Lease Contract, a specialized Agreement Form. It protects the landlord’s property, secures the host’s lease, and guarantees the incoming student a safe place to stay.

Here is a simple, section-by-section breakdown of how the contract works and why it matters.

Section 1 & 2: The Parties and The Property

A standard lease only involves a tenant and a landlord. Because LuluHives connects peers, our contract brings three specific people to the table. Section 1 identifies The Parties Involved:

  • The Property Owner (Landlord)
  • The Outgoing Person (Current Tenant/Host)
  • The Incoming Person (Guest/Sublessee)

Section 2 then establishes the baseline by documenting the Property Address, as well as the Original Lease Start Date and End Date. This ensures everyone is talking about the exact same legal space.

Section 3: Arrangement Checklist & Details

This is where you define the practical realities of the stay. It acts as a clear checklist so there are no surprises:

Type of Arrangement: You will clarify if this is a “Paid Sublease” (where the Incoming Person pays rent to the Outgoing Person) or a “Free Hosting / Swap” (where the Incoming Person is hosted free of charge).

Stay Duration: You must list the exact Start Date, End Date, and total number of days/months.

Financial Terms: If it’s a paid sublease, you log the daily or monthly rent and any security deposit. Crucial Rule: The contract clearly notes that by law, the sublease rent cannot exceed the rent paid by the Outgoing Person to the Owner.

Mandatory Insurance: This confirms that the Incoming Person possesses valid Civil Liability Insurance (Assurance Responsabilité Civile) covering the exact dates of the stay, including their policy number.

Section 4: Terms & Conditions (The Legal Core)

By signing the document, all three parties explicitly agree to terms that act as a formal addendum to the original lease. Here is what those terms mean in plain language:

1. Landlord’s Authorization & Required Documents In France, illegal subletting can get you evicted. This contract serves as the formal, written authorization from the Property Owner permitting the Outgoing Person to sublet. Furthermore, the Outgoing Person must transmit a copy of this authorization and the original lease to the Incoming Person. These rules apply whether the apartment is a furnished rental (location meublée) or unfurnished.

2. Financial Regulations & Rent Caps We protect students from price gouging. The monthly rent billed to the Incoming Person cannot, under any circumstances, exceed the proportional price per square meter paid by the Outgoing Person. Additionally, the payment flow is separated: the Incoming Person pays the Outgoing Person, but the Outgoing Person remains fully responsible for paying the original monthly rent directly to the Property Owner.

3. Liability and Insurance Who is to blame if something breaks? The contract states that the Outgoing Person formally acknowledges they are completely responsible for the subtenant, and they answer directly to the Property Owner for damages. To mitigate this risk, the Incoming Person must hold active Civil Liability Insurance.

4. Subordination to the Original Lease The sublease is entirely subordinate to the primary lease. This means the Incoming Person agrees to respect all rules and usage restrictions outlined in the original lease. Additionally, the sublease automatically terminates on the agreed-upon End Date and cannot exceed the remaining duration of the original lease.

5. The Role of LuluHives LuluHives acts solely as a verified, peer-to-peer matching network; we are not a real estate agency or a direct party to this contract, and we bear no liability regarding rent collection or property condition. However, to protect our community, LuluHives strictly mandates the execution of this contract. Once a match is made, the platform requires this document to be fully signed by all three parties.

Section 5: Rules & Signatures

At the very end, there is an optional section where the host can list specific rules (like a pet policy or smoking restrictions). Finally, the deal is sealed with the mandatory Signatures and dates from The Property Owner, The Outgoing Person, and The Incoming Person.

The Bottom Line: Housing doesn’t have to be a headache. By requiring this tripartite agreement, LuluHives ensures that the landlord’s asset is protected, the host’s lease is secured, and the incoming student gets a verified, legally sound place to call home.
