Introduction and Acceptance: LuluHives (SIRET 930789011) is a French property listing platform covering three categories: long-term rentals, short-term rentals, and sale/purchase of homes. By using the LuluHives website, you acknowledge that you have read and accepted these Terms and Conditions. Accessing or browsing the site implies full acceptance of our terms. Users agree to comply with all applicable French laws and regulations (including real estate marketing laws like the Loi Alur and Loi Hoguet) when using LuluHives.
User Accounts and Registration: To use listing or messaging services on LuluHives, users must register and create a personal account. Registration is free during this trial phase, and each user supplies accurate information to set up the account. We provide a unique username and password after registration, which are strictly personal – you are responsible for keeping them confidential and for all activity under your account. Users bear all costs of connecting (Internet fees, hardware, etc.). We may suspend or terminate accounts that violate our terms, and you may delete your account via your personal space at any time. By registering, users agree to receive communications from LuluHives (e.g. service updates or notices).
Platform Services and Listings: LuluHives provides an advertising platform where property owners and agencies can publish listings for rental or sale. Each listing is for information purposes only; the accuracy and completeness of the content is the owner’s responsibility. LuluHives reviews every listing to ensure it meets basic authenticity standards and then marks approved listings with a “verified” tick. This verification step is in line with French anti-fraud legislation (the law of 30 December 2021 requires platforms to implement measures such as verifying listings before publication). However, LuluHives does not guarantee the truthfulness of listings – as with other listing sites, listings are provided “as-is” and we expressly disclaim liability for any omissions or inaccuracies in owner-submitted content.
- Owner Obligations: Owners and professional advertisers must comply with all French real estate regulations. In particular, licensed agents must hold a valid professional card and financial guarantee as required by the Loi Hoguet (1970). Owners should ensure that each listing includes all legally required information (such as energy diagnostics, surface area, and price breakdowns). LuluHives does not require agencies to have a real estate mandate for advertising; notably, French law states that only a written mandate binds an agent to a sale or rental, and LuluHives as a platform does not replace or imply any agency mandate.
- User Browsing and Contact: Registered users can freely browse all listings and contact owners directly via the site’s messaging feature. All communication and negotiations (viewings, lease terms, sale offers, etc.) occur off-platform between the parties. LuluHives does not mediate these transactions and is not a party to any rental or sales contract.
Fees and Future Pricing: LuluHives is currently offered free of charge to agencies and private owners during this pilot trial (no listing fees or commissions apply). Depending on user feedback and demand, LuluHives may introduce fees or subscription plans in the future; any such changes will be announced in advance and would require user acceptance of updated terms.
Document Requests and Dossier Management: After initial contact, landlords and tenants will need to exchange the customary housing documents (proof of income, identity, tax notices, etc.). LuluHives does not collect or store these personal documents. We recommend using secure, official channels for document exchange. In particular, tenants can use the French government’s DossierFacile platform (dossierfacile.fr) to assemble and validate their rental application documents online. DossierFacile is a free, government-backed service that lets renters upload all required files and receive official validation of their dossier. Using such tools helps protect privacy and prevent identity fraud. Never send sensitive personal files (ID scans, tax forms, etc.) through insecure means or before you have verified the property and landlord.
Fraud Prevention and User Safety: LuluHives emphasizes user caution to prevent scams. Important safety guidelines include:
- Never pay before seeing the property: The golden rule is never to send any deposit, rent, or transfer any payment before you have personally visited the property and verified its existence. Do not “reserve” a property by paying online or via informal methods. A legitimate lease begins with an in-person or legally certified virtual visit and a signed contract; any demand for payment before this point is a red flag.
- Use secure payment methods: Always pay by safe, documented means after keys are handed over. Avoid untraceable payment channels (Western Union, money transfer vouchers, crypto-currency, foreign cash accounts, etc.). For long-term rentals, standard practice is to provide the deposit and first month’s rent after receiving the keys and signing the lease, typically by bank transfer or official check.
Refer: cybermalveillance.gouv.fr - Verify the landlord’s identity: Insist that the person you communicate with is the true owner or a legitimate agent. If anything seems suspicious (e.g. they claim to be abroad and cannot show the property), ask for proof of ownership such as a copy of the property tax statement (“taxe foncière”) to confirm they own the home Cross-check names, phone numbers, and photos online to see if the listing appears elsewhere or if the contact has reports from other users.
- Secure document exchange: Never send unmarked, notarized copies of sensitive documents (ID, bank statements, etc.) to unknown parties. Always transfer required forms through secure channels: for example, by providing the landlord a link to your validated DossierFacile dossier, or by watermarking documents as advised by French authorities. Follow official guidance: never hand over identity or income documents until you are sure of the recipient’s identity and legitimacy.
LuluHives will never ask for payment on behalf of any party, nor handle payments or deposits. We also do not permit any transaction through the platform itself – all payments must be arranged privately by the user. Accordingly, LuluHives is not liable for any loss or fraud if you transfer money or send documents off-site without following these precautions.
Content Accuracy and Liability: LuluHives provides the platform as-is and does not guarantee the accuracy of listings. We are not a real estate agency and do not verify every detail of each listing beyond basic authenticity checks. Consistent with standard practice, all property information (descriptions, images, pricing) is given for user convenience only. Users should independently confirm all facts (rental amounts, property condition, legal compliance) before making any commitments. As one disclaimer puts it, the site’s information is “indicative” with no contractual value. LuluHives and its owners will not be held responsible for any errors, omissions, outdated information, or for any consequences arising from reliance on a listing. We also disclaim liability for any direct or indirect damages (financial, legal, personal injury, etc.) resulting from user conduct or third-party actions. LuluHives cannot control or guarantee the behavior of advertisers or other users.
Intellectual Property: All content on the LuluHives site (including text, graphics, logos, photos, and software) is owned by LuluHives or its licensors and is protected by French and international intellectual property laws. Users may not reproduce, distribute, or commercially exploit any part of the site or its content without prior written consent. Any unauthorized use of LuluHives intellectual property is prohibited and may be prosecuted.
Privacy and Data Protection: LuluHives collects and processes personal data (such as your name, contact details, and identity documents) only to the extent necessary to provide our services. We handle data in compliance with French data protection law (the “Informatique et Libertés” law of 6 Jan. 1978) and the GDPR. Users have the right to access, correct, or delete their personal information at any time. For more details on data handling, see our Privacy Policy. By using the service, users consent to the collection and use of their data as described therein.
Changes to Terms: LuluHives reserves the right to modify these Terms and Conditions at any time without prior notice. We may update the rules as our service evolves. Each time you use the site, you are deemed to accept the latest version of the terms. (As another real estate platform notes, continued access to the site after changes implies acceptance of the new terms.) Users should review the terms periodically.
Summary: In summary, LuluHives offers a free property listing platform where users can create accounts, publish or browse listings, and contact advertisers directly. The platform facilitates connections but does not intervene in transactions. Users should exercise due diligence: verify listings, protect personal data, and follow official guidelines (e.g. DossierFacile for documents). LuluHives is not responsible for third-party actions or fraudulent schemes. Use the site carefully and responsibly, in accordance with these Terms and all applicable laws.
